Bill
CLARITY Act
Details
The "Digital Asset Market Clarity Act of 2025," or "CLARITY Act of 2025," establishes a regulatory framework for digital commodities, granting the CFTC exclusive jurisdiction over spot market transactions and related entities like exchanges, brokers, and dealers. It aims to differentiate digital commodities from securities, introduce a "mature blockchain system" concept for regulatory exemptions, and protect individual self-custody rights.

Significance
Because of the way Senate rules work, CLARITY could not have gotten to a final vote without members voting in favor.

Quoted from standwithcrypto.org · 2026-09-11

Darline Graham completed the Stand With Crypto Questionnaire and expressed strong support for establishing clear legislative frameworks to foster digital asset innovation and leadership in the United States. She advocates for legislation that defines digital assets, protects self-custody rights, and prevents the de-banking of lawful crypto users and businesses. Graham also supports updating market structure laws for digital asset trading venues, believes non-custodial software developers should not be regulated as financial intermediaries, and has co-sponsored the CLARITY Act.

The Senate must deliver a product to the American people that protects consumers, provides law enforcement with the tools they need, and creates regulatory certainty so that the digital asset industry can continue to innovate here in the United States. President Trump through his work with the House and Senate has given us that opportunity through the Clarity Act, and it is time to act now on the Senate floor. I stand with President Trump to deliver for the American people. The Clarity Act is part of the President’s mission to keep American innovation built here at home, and South Carolina will be part of getting it across the finish line. I stand ready to support Chairman Tim Scott, Senator Lummis, and President Trump to create market structure and get this important priority done.
