Bill
CLARITY Act
Details
The "Digital Asset Market Clarity Act of 2025," or "CLARITY Act of 2025," establishes a regulatory framework for digital commodities, granting the CFTC exclusive jurisdiction over spot market transactions and related entities like exchanges, brokers, and dealers. It aims to differentiate digital commodities from securities, introduce a "mature blockchain system" concept for regulatory exemptions, and protect individual self-custody rights.

Elizabeth Warren and the Democrats blocked the Clarity Act because they’d rather obsess over President Trump’s personal finances than establish the necessary guardrails to secure American leadership in digital assets. Even though @POTUS and Senate Republicans have negotiated with them for months in good faith, they couldn’t take off their TDS-tinted glasses to even debate or improve the bill. The choice in front of us is simple: create a market structure for digital assets at home to protect Americans’ involvement in the industry or watch Americans risk their money in unsafe foreign countries led by less than noble leaders. American financial innovation and ingenuity must be protected by an American legal framework. Given Democrats’ obstruction, the administration should use its authority to finalize appropriate market structures for investors in digital assets.

If the United States doesn’t lead with our values and a light-touch regulatory framework, the crypto industry will move offshore. Democrats may not like having a businessman as President, but we shouldn’t abandon pro-growth, pro-business policies simply because they might benefit y.

Spoke with members of the @FMWFChamber during their visit to D.C. From strengthening national defense and energy security to advancing economic growth, North Dakota remains front and center in my work. We talked about key priorities, including immigration and permitting reform, the future of the crypto industry, and investments in North Dakota’s defense ecosystem.

We need U.S. guardrails that clearly delineate between commodities and securities, banking and non-traditional banking. The rules of the road have to be clarified. Our country has a legacy of diverse financial institutions, and we cannot allow digital assets and industry to go overseas.

Senator Kevin Cramer continues to demonstrate his strong support for the digital asset industry. His recent meeting with the Executive Director of the President’s Council of Advisors for Digital Assets to discuss "market structure and pending legislative efforts" is a significant, pro-crypto action. This is exactly the kind of engagement the industry needs. Focusing on building a clear market structure framework is the path to responsible innovation and American leadership in this space. It’s a stark contrast to the regulation-by-enforcement approach that creates uncertainty and stifles growth. Cramer's actions are consistent with his established record. He has repeatedly voted for pro-crypto legislation, including the GENIUS Act to create clear rules for stablecoins and the resolution to repeal the SEC’s restrictive SAB 121. When a US Senator proactively engages with White House advisors to craft sensible rules of the road, it’s an unambiguously positive signal. This is what leadership looks like.

I joined @FoxBusiness to discuss the Senate's passage of @POTUS’ Big Beautiful Bill yesterday. We hit the sweet spot and it’s time for the House to get this done! We also spoke about the Federal Reserve’s slow and contrarian policy on interest rates and the importance of passing the GENIUS Act to establish pro-growth policies for cryptocurrencies.

Bill
GENIUS Act
Details
The GENIUS Act of 2025 proposes a regulatory framework for payment stablecoins. It defines permitted issuers (insured depository institutions, their subsidiaries, and approved nonbank entities) and mandates 1:1 reserve backing with specific high-quality assets. The bill outlines federal and state regulatory oversight options, sets requirements for customer asset segregation, and grants stablecoin holders priority in insolvency proceedings. It also clarifies that regulated payment stablecoins are not considered securities or commodities under various acts. The bill designates issuers as financial institutions under the Bank Secrecy Act, requiring compliance with AML, KYC, and sanctions regulations to prevent illicit finance and safeguard national security. It also reinforces U.S. leadership in digital finance by supporting innovation and ensuring the dollar remains competitive in a rapidly evolving global financial landscape.

Anti-CBDC Surveillance State Act
Details
This bill proposes to amend the Federal Reserve Act to explicitly prohibit Federal Reserve banks from offering products or services directly to individuals or maintaining individual accounts. Crucially, it bans the Federal Reserve from developing, testing, implementing, or issuing a central bank digital currency (CBDC), either directly or indirectly, and from using a CBDC for monetary policy. The legislation defines CBDC as a direct liability of the Federal Reserve System, denominated in the national unit of account, and widely available to the public.
