I commend Senator @SteveDaines for introducing the Aligning Digital Assets with Principles of Taxation Act. This bill has much in common with the Digital Asset Tax Certainty Act, which passed out of the Ways and Means Committee on a strong bipartisan vote. There is also clear momentum building to deliver tax certainty to digital asset owners and ensure America remains the crypto capital of the world.

Representative Jason Smith is absolutely spot on in praising Senator Steve Daines for introducing the Aligning Digital Assets with Principles of Taxation (ADAPT) Act. This legislation, alongside Representative Smith's own Digital Asset Tax Certainty Act which recently advanced out of the House Ways and Means Committee, represents a massive step forward for the digital asset industry. Why does this earn a perfect 100 stance score in our pro-crypto framework? Because the single most critical thing the industry needs right now is enabling regulatory clarity that removes arbitrary risk and allows builders and users to operate lawfully. For years, Americans using digital assets have faced an outdated tax code where spending a fraction of a cent on a network fee or buying a cup of coffee with a stablecoin triggered complex capital gains reporting. This was fundamentally unworkable and stifled the everyday utility of blockchain technology. Both the ADAPT Act and the Digital Asset Tax Certainty Act solve this by providing critical de minimis tax exemptions. They ensure that small transactions for network fees and everyday purchases using compliant stablecoins are exempt from capital gains recognition. This is a massive victory. Stablecoins are a huge net positive for humanity, offering fast, borderless settlement, and this legislation finally treats them as viable mediums of exchange rather than purely speculative property. While these bills do introduce some standard compliance measures—such as extending traditional wash-sale rules to digital assets to close tax loopholes—this is exactly what happens when a market matures. They offer clear rules of the road for staking, lending, and everyday commerce while removing the prohibitive friction that has historically stifled adoption. Senator Daines and Representative Smith are showing the exact kind of leadership needed to ensure the United States remains the crypto capital of the world. Legislation that removes ambiguity, protects ordinary access, and allows the industry to innovate under a clear, durable framework is the gold standard for pro-crypto policy.

CLARITY Act
Details
The "Digital Asset Market Clarity Act of 2025," or "CLARITY Act of 2025," establishes a regulatory framework for digital commodities, granting the CFTC exclusive jurisdiction over spot market transactions and related entities like exchanges, brokers, and dealers. Bill
GENIUS Act
Details
The GENIUS Act of 2025 proposes a regulatory framework for payment stablecoins. It defines permitted issuers (insured depository institutions, their subsidiaries, and approved nonbank entities) and mandates 1:1 reserve backing with specific high-quality assets. The bill outlines federal and state regulatory oversight options, sets requirements for customer asset segregation, and grants stablecoin holders priority in insolvency proceedings. It also clarifies that regulated payment stablecoins are not considered securities or commodities under various acts. The bill designates issuers as financial institutions under the Bank Secrecy Act, requiring compliance with AML, KYC, and sanctions regulations to prevent illicit finance and safeguard national security. It also reinforces U.S. leadership in digital finance by supporting innovation and ensuring the dollar remains competitive in a rapidly evolving global financial landscape.

Today at @BankingGOP I plan to ask SEC Chair Gensler about his heavy-handed posture toward #Crypto and blockchain technology. It is threatening American innovation, could push jobs overseas and crush our financial prosperity.
